By downloading, installing, or using the Tacktiq application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legal agreement between you and Gybe Digital LLC, a Massachusetts limited liability company ("Gybe Digital," "we," "us," or "our").
You must create an account to use Tacktiq. You are responsible for:
You must be at least 13 years old to create an account. By creating an account, you represent that you meet this requirement.
Subject to these Terms, Gybe Digital grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial sailing performance tracking purposes.

Tacktiq offers a free tier with limited features and a Pro subscription with full access to AI coaching, advanced analytics, and unlimited session history.
You can cancel your subscription at any time through iOS Settings → Apple ID → Subscriptions → Tacktiq. Cancellation takes effect at the end of the current billing period — you retain Pro access until then. We do not offer partial refunds for unused subscription time.
All purchases are processed by Apple. Refund requests must be made directly to Apple at reportaproblem.apple.com. Gybe Digital has no ability to issue refunds directly.
You retain ownership of all sailing session data, GPS tracks, and performance data you create in Tacktiq. By using the App, you grant Gybe Digital a limited license to store, process, and analyze your data solely to provide the App's features to you.
We do not claim ownership of your data. You can export or delete your data at any time. See our Privacy Policy for full details on data handling.
Tacktiq is a performance coaching tool, not a navigation aid. Do not rely on Tacktiq for safety-critical decisions on the water. GPS data may be inaccurate. Always maintain proper watch, follow the Collision Regulations (COLREGS), and use certified navigation equipment. Gybe Digital accepts no liability for any incident, accident, or loss arising from use of the App on the water.
The AI coaching feature provides suggestions based on performance data. These suggestions are for training and improvement purposes only and do not constitute professional sailing instruction or safety advice.
The Tacktiq Coach feature uses Anthropic's Claude AI to generate coaching responses. You acknowledge that:

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GYBE DIGITAL DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYBE DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Suffolk County, Massachusetts.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gybe Digital regarding the App and supersede all prior agreements.
